By downloading, installing, or using Dockmates ("the Software"), you agree to these terms. If you do not agree, do not use the Software.
License
We grant you a personal, non-exclusive, non-transferable license to use Dockmates on your Mac for personal or commercial purposes. You may not redistribute, resell, sublicense, reverse-engineer, or create derivative works from the Software.
No Warranties
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE, UNINTERRUPTED, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SOFTWARE IS ENTIRELY AT YOUR OWN RISK.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DOCKMATES, ITS OWNERS, OFFICERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO: LOSS OF DATA, LOSS OF PROFITS, LOSS OF BUSINESS, SYSTEM DAMAGE, UNAUTHORIZED ACCESS, DATA BREACHES, OR ANY OTHER PECUNIARY LOSS ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE SOFTWARE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY CASE, OUR TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE (USD $1.00).
Release of Claims
By using Dockmates, you fully and irrevocably release, discharge, and hold harmless Dockmates and its owners, agents, and representatives from any and all claims, demands, actions, causes of action, liabilities, damages, losses, and expenses (including attorneys' fees) of any kind arising out of or related to:
- Your use of or inability to use the Software
- Any content or responses generated by third-party AI services
- Any data loss, system damage, or security incident
- Any unauthorized access to your data or systems
- Any act or omission of a third-party service provider (including AI or payment processors)
Third-Party AI Services
Dockmates routes queries to third-party AI services (such as OpenAI or Anthropic). We have no control over and assume no responsibility for the accuracy, completeness, or appropriateness of AI-generated responses. You use AI features at your own discretion and risk.
Payments & Refunds
Purchases are processed by Stripe and are final. Because the Software is delivered digitally and immediately upon payment, we do not offer refunds. If you experience a technical issue, contact us and we will do our best to help.
Acceptable Use
You agree not to use Dockmates for any unlawful purpose or in any way that could damage, disable, or impair the Software or interfere with other users.
Changes to These Terms
We may update these terms at any time. The "last updated" date above reflects the most recent revision. Continued use of the Software after changes constitutes your acceptance.
Governing Law
These terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Santa Clara County, California.
